Man wins case over unfair capital gains tax on home that lost value

Ruling in Fuengirola case is the first of its kind in Málaga province

Some sellers find themsleves taxed on captial gains despite losing money on the sale of a property

A man who was charged €5,000 in ‘plusvalía’ capital gains tax on the sale of a home in Fuengirola, despite having sold it for much less than he had bought it for, has won a court case to have the tax annulled.

It is the first known ruling of its kind in Málaga province.
